Employers’ liability explained

Why most UK employers need this cover, how it differs from public liability, and what to check on the certificate.

Features, cover levels, exclusions and prices vary by provider. Cover is subject to underwriting and terms. Quotes depend on personal or business circumstances. Always check the provider’s documentation before buying.

A legal requirement for most employers

Most UK businesses that employ staff are legally required to hold employers’ liability insurance, subject to limited exemptions. The cover is aimed at injury or illness employees may suffer as a result of their work. Check current legal requirements for the minimum limit, who counts as an employee, and any exemptions that may apply.

Not the same as public liability

Public liability is aimed at members of the public or clients. Employers’ liability is aimed at people who work for you. A contractor-only business is not automatically exempt — some workers may still be treated as employees for this purpose. If you are unsure, that is a legal and insurance question for a regulated adviser or the insurer, not a comparison page.

Certificates and claims

Insurers issue an employers’ liability certificate that some businesses must display or make available. Claims can arise years after the work took place, which is why records matter. Compare the limit, any trade exclusions and whether cover is arranged direct or through a broker.
